Residents fined for not clearing wood pallets, glass and waste from garden

Two residents have been found guilty of failing to clear waste from the garden of their property.

Carla Stokes, 28 and James Silvester, 34, were convicted of breaching a Community Protection Notice for failing to dispose of waste from their property on Harris Road, Kirkby-in-Ashfield.

The notice was issued to Stokes and Silvester in May 2019 following complaints from neighbours.

Ashfield District Council’s anti-social behaviour & nuisance officers had "provided, advice, support and guidance" to them on how to correctly dispose of their waste, however this advice was ignored.

The complaints continued and the council made the decision to take enforcement action.

Failing to appear at Mansfield Magistrates' Court on January 15, a fine was imposed on each defendant of £120 with a contribution of £260 to the council's overall costs.

Silvester was also handed a remedial order - which required him to clear the waste from the front and back gardens of the house by February 12 -  which included wooden pallets, glass, building waste and household waste, as well as dog mess.

Councillor Daniel Williamson, cabinet member for community safety at Ashfield District Council said: "The council will not tolerate residents who think it is okay to commit anti-social behaviour.

"As this case demonstrates we will prosecute those who fail to comply with Community Protection Notices.

"The council is committed to tackling anti-social behaviour and this should act as a warning to those who think they can get away with it.”
