Rajasthan HC adjourns hearing on REET paper leak case to February 28

JAIPUR: Rajasthan High Court on Tuesday adjourned the hearing on the petition seeking a CBI inquiry into the REET paper leak case to February 28.

The state government said since REET 2021 level-II examination had been cancelled, petitions filed in this regard should be dismissed as it had become infructuous. Advocate general MS Singhvi, appearing for the state government, said in the court on Tuesday that since the level-II examination had been cancelled, the petition does not stand a ground and should be dismissed. He said the SOG was investigating into the matter and many accused had been arrested.

Petitioners opposing the argument said both level-I and level-II papers of REET should be cancelled and a CBI inquiry should be conducted. “No one should be given appointment till the CBI probe is completed. If the recruitment process is not stopped, then ineligible candidates will get appointment and qualified ones will be out of the selection process,” the petitioners said. The court of Justice Mahendra Goyal then adjourned the hearing till February 28. Bhagchand Sharma and others had filed a petition saying SOG had admitted that the question paper was stolen from the Shiksha Sankul and was sold for crores of rupees.

Stay on issuance of cert to lawyers’ association: The HC has given an interim stay on the issuance of registration certificate to Rajasthan High Court Senior Lawyers Association by the cooperative department. The court gave the order on a petition by HC Bar association general secretary Giriraj Sharma. According the notice, the cooperative department, senior lawyers association president advocate Poonam Chand Bhandari and others have to respond in five weeks.

Rajendra Prasad, counsel for the petitioner, argued that the co-operative department is in the process of giving registration certificate to the new organisation named Rajasthan high court senior lawyers association.

Whereas, according to the rules, the name of 'high court' cannot be used anywhere without the permission of the High Court. Under the Advocates Act, there are only two categories of lawyers, senior advocate and advocate. He said none of the office bearers of the senior lawyers association have been nominated as senior advocates by the High Court. In such a situation, they cannot even write senior lawyers for their association.
