Predatory pensioner sexually assaulted disabled woman in Kilmarnock town centre

A pensioner who sexually assaulted an “extremely vulnerable woman” in a wheelchair has been jailed.

Predator Robert Lundy admitted seizing hold of her and kissing her head and mouth on February 20 in Kilmarnock’s King Street.

At Kilmarnock Sheriff Court, the 69-year-old’s defence agent explained: “Mr Lundy requests the court do not wish for any background reports and simply wishes the matter is dealt with today.”

Prosecuting, Asif Hussan told the court the victim has cerebral palsy and is wheelchair bound. As a result of this, carers are with her daily to assist with her needs.

Mr Hussan explained the victim was shopping within Kilmarnock town centre.

As she travelled up King Street, she was approached by creepy Lundy, of Broad Street in Glasgow, who tried to engage in a conversation.

Without any warning or consent, seized hold of her by the neck and stated: “I love you.” The woman attempted to release his grip by turning her head in a side motion but wasn’t able to do so.

Lundy then lent down towards her and kissed her mouth and over her nose.

The poor woman stated this lasted about 30 seconds.

Having now released his grip, the creep made off, leaving the victim extremely frightened and upset.

To get away from the scene, she made her way in to a shop and asked for assistance and the police were contacted.

Lundy wasn’t traced at that time but police viewed CCTV and arrested Lundy at home at 8pm the following day.

Lundy’s solicitor said his client apologised for his actions. He explained he has been subject to the notification requirements of the sex offenders’ register for a “number of years” and has “very regular contact with the police.”

He told how Lundy was involved in a “similar incident” last year that resulted in him going to prison.

“The main difficulty is a very serious and long-standing problem with alcohol,” the agent added.

Sheriff Lindsey Kooner said: “This behaviour was inexplicable. It was an assault on a woman who is extremely vulnerable.”

East Ayrshire police chief inspector Gillian Docherty said: “Robert Lundy has taken advantage of a vulnerable member of our community who he did not know, while she was going about her business.

“His victim will no doubt be affected by this experience for a long time but she has shown tremendous bravery in coming forward and assisting officers with this inquiry.

“Without her courage, Lundy would not be behind bars today and I hope this result encourages other victims to come forward.”

Sheriff Kooner added: “You have a very significant record of convictions. The court takes note of your apology but you have a directly analogous matter from 2018. I find this a very serious matter considering the position the victim found herself in as a result of your actions.”

Lundy was jailed for 158 days and made subject to the notification requirements of the sex offenders’ register for seven years.
