Pothole compensation claims made to West Dunbartonshire Council all rejected

West Dunbartonshire Council is the only local authority in Scotland not to pay out on a single pothole compensation claim.

New figures released following a Freedom of Information (FOI) request showed that 36 claims were made by motorists for damage caused by crumbling roads in the area, but all of these were rejected.

Previously 38 claims had been made in 2020/21, with eight paid out - totalling £1,356.

In 2019/20 two appeals were accepted, with £351 paid in compensation.

Neighbouring Argyll and Bute, which includes Helensburgh and Cardross, paid out a total of £2,884 - with nine of the 24 claims made upheld.

Across the country only one in six claims for damage caused by potholes were compensated, however West Dunbartonshire is the only region where claims were received - but none were upheld.

The council’s say the rejection of a claim means they were deemed not to be at fault. But their Facebook page shows the condition of the roads is still an issue for drivers, with frequent complaints made about the condition of vital routes, as well as residential streets - with Sandbank Crescent in Bonhill likened to a rollercoaster, by one angry resident.

Scottish Conservative shadow transport minister Graham Simpson MSP said: “The dire condition of our roads is an extremely serious issue. Far too many local routes across Scotland are scarred with potholes which damage vehicles.

“By imposing years of systematic and continued budget cuts, Nicola Sturgeon’s government are starving councils of the cash needed either to carry out essential repairs or to compensate drivers affected by their failure to do so.

“Scotland’s pock-marked roads require urgent attention, and the SNP ought to commit to establishing Pothole Action Funds”

A spokesman for Deputy First Minister John Swinney said: “Maintenance of the local road network is the responsibility of local authorities and it is up to individual councils to manage their own budgets and allocate the total financial resources available to them on the basis of local needs and priorities.”

A spokesman for West Dunbartonshire Council added: “All claims received are assessed by independent claims handlers. Claims are rejected if no fault or liability can be attributed to West Dunbartonshire Council.”
