Police officers were assaulted in Eastwood by topless man covered in blood

A man covered in blood was hit with a police baton, squirted with CS spray and had a Taser pointed at him while police attempted to arrest him, Nottingham Crown Court heard.

But despite the methods used by officers to detain Brandon Appleby as he assaulted them, the 27 year old managed to continue shouting at them.

The court heard Appleby was eventually arrested and said "yeah, well, I have mental health issues, so".

The drama began shortly before 3am on December 23 last year when police attended his address, in Princes Street, Eastwood, where a woman was screaming at Appleby to "put the knife down!"

She ran from the address clutching her face and crying uncontrollably, while Appleby, who was topless, waved his arms about and was seen to have gashes to his chest and cuts to his arms.

Appleby ran towards one of the officers, who thought he may have a knife, so he got out his Taser and marked him with a red dot.

In response Appleby dropped to his knees saying, "I submit, I submit".

All parties moved inside where the same policeman got out his handcuffs.

Appleby then stood to his feet and charged towards him, slamming into him and knocking him off his feet, the court heard.

The officer knocked his head on a wall and later needed five stitches to a wound.

His colleague alerted other officers on her radio and used her baton on Appleby's lower body.

She fell against a wall when he hit her with the palm of his hand. Then her injured colleague moved in and used his CS spray.

Matthew Smith, mitigating, explained it was a reckless, rather than deliberate, blow to the officer, and there was no intention to cause injury.

Appleby has ongoing mental health problems, but a psychiatrist has said a hospital order is not appropriate at this stage.

He pleaded guilty to assault, causing bodily harm on the policeman, and assaulting the policewoman

Sentencing him, Judge Stuart Rafferty QC said: "For reasons that no one will ever fully understand, including you, on the night these offences were committed you effectively lost control of yourself".

He imposed a total of 18 months in prison, suspended for two years, and a community order and 60 rehabilitation days.
