Police officer 'kicked in the nuts' by jobless man

A jobless man must pay £150 compensation to a police officer for kicking him in a painful place.

The incident happened in the front garden of a house on Beechdale Road, city magistrates heard.

It was caught on cameras worn by the officers and the footage was played in court - with officers heard urging 
him to leave.

One tells drunk Jovann Duporte: "She doesn't want you here tonight. Where do you want to go? All right, have a good night - don't come back."

But soon after, a policeman is heard saying: "You've just kicked me in the nuts."

Duporte pleaded guilty to assaulting an emergency worker on duty on July 12. He was fined £200 and must pay £85 prosecution costs on top of the compensation.

Sanjay Jerath, prosecuting, told magistrates: "They placed handcuffs on and the defendant kicks out, catching the officer between the legs.

"He said later that he didn't mean to connect but the officer was simply doing his job."

Alias Yousef, mitigating, said: "It was a donkey kick - he didn't know the officer was standing behind him.
"He had no intention to hurt the officer."

It happened at the home 26-year-old Duporte shares with his mother. He had "too much to drink" one night.

Mr Yousef told the magistrates: "His mother would not let him into the house and called the police.

"He decided to sleep in the front garden. The police attended and he didn't want to go into the police vehicle.

"While he was escorted to the police vehicle, without knowing what he was doing, he kicked out."

A probation report said: "He doesn't dispute he did what he did.

"He says that it was accidental. There is nothing to suggest any likelihood of re-offending."
