Police were called to the crash in Whyalla Stuart about 11:45am on July 8.

A 12-year-old boy has been charged by police after allegedly driving a car that crashed, killing one man and seriously injuring another child in South Australia's Spencer Gulf region earlier this month.

Police and emergency services were called to Jubilee Park in Whyalla Stuart, about 400-kilometres north of Adelaide, about 11:45am on July 8 after a Holden Commodore lost control and rolled into scrub.

A 20-year-old man from Whyalla Stuart, who was a passenger in the car, was seriously injured in the crash and airlifted to the Royal Adelaide Hospital.

Police said he died of his injuries at hospital on Sunday.

Another passenger, an 11-year-old boy, suffered multiple limb injuries in the crash and was taken to the Whyalla Hospital for treatment.

Police said the driver, a 12-year-old boy, was treated for minor injuries and was later that day arrested and charged with two counts of cause harm by dangerous driving.

However, police today said one of the counts is expected to be upgraded to cause death by dangerous driving.

He was refused bail and appeared in the Whyalla Youth Court on July 9,where he was remanded in custody to appear in the Adelaide Youth Court on July 22.

Police said the road toll in South Australia now sits at 55, compared to 65 at the same time last year.
