'People were having a good time... but you were not in a festive mood': Christmas Day argument ended in a screwdriver attack

A family row on Christmas Day ended with a man being attacked with a screwdriver, a court heard.

Marcian Hordejuk, 33, assaulted his mother's friend after turning up at her flat drunk.

"There were other people present, and they were no doubt having a good time," Judge Patrick Field QC told Hordejuk.

"You, however, were not in festive mood."

Manchester Crown Court heard that Hordejuk's partner was at the flat in Eccles, Salford, on December 25, 2018, and he turned up later shouting and banging on the door.

The couple argued, and Hordejuk also had a row with another man, a friend of his mother's.

The argument 'escalated' and Hordejuk pulled out a screwdriver, prosecutor Peter Gilmour said.

Hordejuk 'repeatedly' hit him to the head with it.

The victim later went to hospital, but he only suffered 'relatively minor' injuries including grazes to his scalp.

After being arrested, Hordejuk denied using a screwdriver and claimed any blows he may have struck would have been in self defence.

The victim's DNA was found on the tip of the screwdriver.

Hordejuk initially pleaded not guilty, but later admitted an offence of assault occasioning actual bodily harm.

The court heard Hordejuk has previous convictions in his native Poland, but has no criminal record during his seven years living in the UK.

Defending, Daniel Calder said the attack was an 'isolated incident' which was 'out of character'.

He said Hordejuk has a settled family life and caring responsibilities for his partner and son, as well as a full time job working in a warehouse.

Mr Calder said Hordejuk 'no longer drinks to excess', and argued he would be unlikely to appear before the courts again.

Sentencing, Judge Field told Hordejuk: "It was Christmas Day in 2018, when you turned up at your mother's flat.

"You were shouting and behaving aggressively, and most probably were drunk.

"You were spoiling for a fight, you argued with your partner and you ended up arguing and fighting with your mother's friend.

"You attacked him with a screwdriver, causing some relatively minor injuries to his scalp.

"This was unacceptable violent behaviour, that undoubtedly caused a significant amount of upset and disappointment in your behaviour, and no doubt left him with a sore head."

The judge said he could spare Hordejuk jail because it would have a 'disproportionate' effect on his family if he were incarcerated.

Hordejuk, of Haymond Close, Salford, was sentenced to 32 weeks in prison, suspended for 12 months.

He was also ordered to pay £600 towards prosecution costs.
