KOCHI: The Kerala high court has lifted the condition imposed on former PWD minister VK Ebrahim Kunju while granting bail in Palarivattom flyover corruption case that he should not leave Ernakulam district.
Allowing the plea for lifting of bail condition, justice PV Kunhikrishnan said a person’s liberty to move cannot be restrained indefinitely citing through a bail condition. The court also noted that the petitioner had obeyed the condition for the past six months.
The former minister had contended that his continued presence in the district was not essential for the investigation or for any related purposes. Therefore, no prejudice would be caused if the condition is lifted, his plea stated.
Even though prosecution argued that the petitioner is highly influential and should not be allowed to enter Thiruvananthapuram district, the court said it cannot interfere with one’s liberty to travel indefinitely. The former minister is the fifth accused in the case related to alleged malpractices in the contract related to construction of Palarivattom flyover.
