Paisley dealer and girlfriend attacked cops in street

A Paisley couple attacked cops moments before a large stash of heroin was discovered in their flat.

James McIlhargey, 35, and girlfriend Corrina Caldwell, 33, assaulted officers called out to their home at Bargarron Drive, Gallowhill, in Paisley.

McIlhargey was first pulled over at the wheel of his white BMW for drink driving following a tip-off to police on May 29, last year.

Paisley Sheriff Court heard his partner Caldwell leaned out of the window and accosted cops in the street, who were dealing with her partner.

When cops entered the close the couple attacked them, with McIIhargey pushing a constable and Caldwell repeatedly kicking officers.

When cops got a warrant to search their flat, they discovered around 50 grams of heroin in a tupperware box, a set of scales and book containing a list of names and numbers.

The court heard the drugs would fetch £2,000 if sold in deals, according the police Statement of Opinion Unit.

Procurator fiscal depute Ed Sheeran said cops received an anonymous phone call about McIlhargey and found him in the driver’s seat of the BMW, “smelling of alcohol.”

He said: “His speech was slurred and he was unsteady on his feet.

“They became aware of the accused Caldwell leaning out of the window and due to their concerns decided to usher McIlhargey into the close in order to speak to Caldwell as well.

“A disturbance broke out. McIlhargey pushed a constable on his body.

“Caldwell kicked the constable on his leg. She also repeatedly kicked another constable on his leg.”

The fiscal added Caldwell also repeatedly kicked a woman constable, causing injury to the cop’s hand.

The court heard when police were taking them into custody, they were asked to fetch Caldwell’s medication.

Mr Sheeran said: “Within a bedside cabinet drawer, police observed a tupperware container containing a large amount of brown powder.

“They obtained a search warrant and items including the 47.2 grams of powder, a set of scales and notebook containing names and numbers, were recovered.”

The substance was analysed and found to be heroin.

Yesterday McIlhargey pleaded guilty to a charge of possession of a Class A substance, namely diamorphine, with intention to supply to others.

He also admitted operating a vehicle while the proportion of alcohol on his breath was 55 micrograms, per 100 millilitres of breath, and the legal limit is 22 micrograms.

He also admitted a charge of police assault.

Caldwell pleaded guilty to three charges of assaulting police by repeatedly kicking officers.

One officer had to attend the Royal Alexandra Hospital for treatment to her hand, which suffered a cut and bruising.

Sheriff Brian Mohan warned McIlhargey he is likely facing a jail sentence for drug dealing, road traffic matters and assault, once he has obtained background reports in preparation for sentencing.

He also slated first offender Caldwell for her “egregious behaviour,” but said he would study reports before deciding her punishment.

Both will discover their fate when they appear back at court on July 27.
