The owners of a luxury villa have been ordered to stop letting it on Airbnb after furious neighbours about rowdy guests.
Kenneth and Margaret Kennedy used the popular site to allow visitors to use their six-bedroomed house for holidays, celebrations and stag parties.
The property in Dullatur, Lanarkshire, hosted up to 12 guests and was advertised as a 'stunning villa' at a prestigious address.
But angry neighbours had complained about guests and claimed noise and parties were making their lives a misery and even impacting mental health.
Council bosses investigated and issued an order halting the Kennedys from letting the house under planning rules.
The couple turned to the government in a last bid to continue the business but have now been told that has failed.
More than 20 letters of complaint from irate neighbours had claimed visitors to the house - which has been let since 2016 - caused them disruption.
Alan Davidson wrote: "The disturbance caused by the property being let as an Airbnb is greatly in excess of that which would be expected from a normal residence.
"The property is often used by large groups and parties. This causes distress for neighbours whose peaceful enjoyment of their property in a largely quiet residential neighbourhood is impacted."
Clare Ross added: "I am acutely aware that over the the last few years this has increasingly affected the mental health and general well-being of the residents living beside, behind and in front of The Kennedy House.
"The mere size of the house attracts large groups of people who are mostly there to 'party' and whilst this is acceptable on occasion the relentlessness of this is having a negative affect on the day to day lives of the residents, which includes young families and older residents who live in Dullatur."
Dullatur Community Council wrote: "Despite assurances that there are conditions of hire in place we have had reports of excess noise/music, swearing, litter, excess traffic of cars, minibuses and limos and late-night parties.
"Some residents of The Lane have young families and there is a children's play park at the entrance of The Lane, with most hirers being one-time visitors and often groups of stag and hens parties any rules or conditions of hire are very often breached and any reprimand after the event is futile.
"This situation is particularly worse in the summer months when use of the barbecue and hot-tub and garden has significant intrusion from outdoor noise on the residents of Dullatur.
"It appears that the only benefitting parties to the current status are the renters, their guests and the appellants."
The Kennedys had rejected the neighbours complaints and insisted they had not breached planning rules.
They said: "We decline guests if we think that they do not fit the profile of a family group or a group looking for a relaxed getaway.
"We do not allow parties or events. Indeed, Airbnb have introduced a blanket ban on parties.
"We speak to all of our guests prior to arrival, to inform them of our policy for noise, disturbance etc.
"No noise outside after 10pm, no fireworks, no karaoke machines.
"On arrival, we meet and greet all of our guests to take them through health and safety and the rules of booking, which they have signed up to prior to their visit.
"We emphasise that our home and our neighbourhood should always be treated with respect."
Government reporter Elspeth Cook said: "While I accept that the appellants do not advertise the property as a 'party' venue, the online booking site extracts indicate that the property has been advertised as suitable for a range of activities including a wedding venue, celebrations, funerals and corporate events.
"The online reviews confirm it has been used for hen or stag weekends, family birthday parties, Christmas festivities and wedding celebrations.
"Such gatherings or celebrations, whether described as a party or not, are likely to lead to additional activity, noise or disturbance at the property particularly at the weekends and in the evenings."
She concluded: "I find that a breach of planning control has occurred and I dismiss the appeal and uphold the enforcement notice."
