Ondrej Kudela 'cannot be extradited' to Scotland over Rangers race row 'without his consent'

Ondrej Kudela may not be forced to bear the brunt of potential legal consequences relating to recent alleged racism incident during Rangers game without his consent - because of Brexit.

UEFA have banned the Slavia Prague defender for allegedly calling  Rangers  star  Glen Kamara  a 'f****** monkey' in last month's Europa League tie and Kudela will miss the next 10 UEFA matches - ruling him out of Euro 2020 and a Hampden group stage meeting with Scotland.

While many here believe a harsher ban was necessary to prove racism won't be tolerated in our game, the decision has been met with an opposite reaction in the Czech Republic, with even the Head of Office for President Milos Zeman slaughtering the European governing body in a disturbing statement.

Following the  UEFA  ban, Kudela was reported to the Procurator Fiscal by Police Scotland.

He could face up to six months in prison if convicted of 'racially aggravated conduct' - but extraditing Kudela to the UK is now tricky thanks to the decision to leave the EU.

When the UK left the European Union on December 31, it also ended its participation in the European Arrest Warrants scheme and while ten countries will not extradite criminals, a further two - Czech Republic and Austria - will now only do so with their consent of the individual.

Czech Minister of Justice Vladimír Repka explained: "We now do not allow the transfer of a Czech citizen to the United Kingdom for criminal prosecution or execution of a sentence without his consent."

However, Kudela's lawyer, Radek Pokorny, insists they will cooperate fully with the investigation, although it's been reported in the Czech Republic that Kudela has not yet been interviewed by the police.

He added: "The police have handed over the investigation to the public prosecutor for further steps. At the same time, evidence is gathered to decide whether or not to charge.

"At present, it is a process of cooperation with the Scottish police and with the full cooperation of both Slavia and Ondrej Kudela.

"They are also proceeding in the same way about the possible assault in the tunnel after the match."
