Noisy neighbour prosecuted after complaints over loud television

A Hucknall resident has been prosecuted for a breach of a Noise Abatement Notice following several warnings and complaints from neighbours.

Ashfield District Council received numerous objections from locals alleging noise from a loud television and other audio equipment coming out of the home.

Andrew Spencer of Sheridan Way, Hucknall, was convicted at Nottingham Magistrates Court on June 28.

A council spokesperson said that following an attempt by the council to mediate the situation, Mr Spencer continued to ignore all warnings.

Neighbours decided to take action by recording the commotion and, after the council reviewed the tapes, it was decided that the noise constituted a statutory nuisance.

The 56-year-old was handed an £80 fine.

Mr Spencer was found guilty at a hearing of two offences under the legislation which allowed the council to permanently take away the audio equipment from his home.

Councillor Helen-Ann Smith, Cabinet Member for Community Safety, said: “This is an excellent result for the Community Safety Team.

“Spencer continually ignored warnings and mediation and continued to cause a noise nuisance. He had no thoughts or consideration for his neighbours.

“This should act as a warning to anyone else who is in the minority of residents who cause nuisance or make life miserable for their neighbours

“We will not tolerate any kind of anti-social behaviour in Ashfield, and we will pursue enforcement action when we can.”

On top of the £80 fine Mr Spencer was also required to pay a contribution of £400 to the council and a victim surcharge of £34, totalling £514.
