No need of CBI probe in Dileep conspiracy case, says Kerala govt.

The Kerala government has reiterated its position that a CBI investigation is not necessary in the case related to the alleged conspiracy hatched by actor Dileep to harm the police officers probing an actor rape case.

The State informed the Kerala High Court on Thursday that there were no complaints against the current police probe and hence a probe by the Central Bureau of Investigation was not necessary in the case.

The High Court, which is considering a petition of the actor seeking to quash the FIR registered in the alleged conspiracy case, had sought the views of the State government in entrusting the probe to some agencies. The court had asked the prosecution whether the investigation officers had any special interest in the case.

The court had also asked the prosecution why filmmaker Balachandrakumar, who claimed to have possessed crucial evidence against the actor in the conspiracy case, took so long to bring it up to the attention of the police. The filmmaker had handed over sound clips related to the conspiracy, which he had reportedly recorded in 2017, to the police in 2021.

The prosecution submitted that the actor had destroyed crucial evidence from his phones. Though he was asked to produce his seven phones, he produced only six. Crucial information was removed from the phones submitted, the prosecution said.

Counsel for the actor submitted that the police were hunting him down, adding that the police cooked up the conspiracy case for creating evidence in the rape case.

The information given by Balachandrakumar regarding the alleged conspiracy was a typed complaint and two statements were given to police officer Baiju Paulose. All the materials taken together did not disclose any offences. The offences incorporated against Dileep were non-cognizable and could not be registered without approaching a magistrate or sending the complaint to a magistrate, submitted the counsel.
