Nirbhaya gangrape convict Mukesh Singh on Saturday moved a plea in the Supreme Court challenging the President’s rejection of his mercy petition on January 17.
The petition, filed under Article 32 of the Constitution, has sought a stay of the execution of the death warrant. The sessions court had ordered the death sentence to be carried out on February 1.
Singh has asked the court to call for his medical records, dating back to the time of his arrest and incarceration, which were placed before the President for a decision on his mercy plea. He has also sought for the jail records of his solitary confinement.
This development comes shortly after the Supreme Court had rejected a juvenility plea by another Nirbhaya convict, Pawan Kumar Gupta.
Akshay Singh, Mukesh Singh, Pawan Gupta and Vinay Sharma had brutally gang-raped a 23-year-old paramedical student in a moving bus on the intervening night of December 16-17, 2012. She died of her injuries a few days later.
Court disposes petition
Meanwhile, a Delhi court on Saturday said no further directions were required on a plea by the lawyer of the death row convicts in the gang rape and murder case alleging the prison authorities were not handing over certain documents required to file mercy and curative petitions, and disposed of the petition.
Additional Sessions Judge Ajay Kumar Jain said the convicts’ lawyer can take pictures of the relevant documents, notebook and paintings or sketches from the Tihar jail authorities.
The court noted that the jail authorities had already complied with the request made by the convicts by supplying the documents whatever was lying with them.
