New Aldi sportswear range mimics Nike as M&S launches Colin the Caterpillar biscuits

Undeterred by its legal wrangle with Marks and Spencer, Aldi has now started to mimic sportswear giant Nike.

It comes as Marks and Spencer launches Colin the Caterpillar biscuits - and Waitrose joined forces with Aldi to take the biscuit in the ongoing #FreeCuthbert saga.

M&S launched legal action against Aldi to protect its Colin the Caterpillar, claiming its rival’s Cuthbert the Caterpillar product is so similar it infringes its trademark.

The news broke as M&S released Colin the Caterpillar Button Biscuits, priced at £1. Last week, the NewFoodsUK Facebook page said: "New Colin the Caterpillar Button Biscuits! Chocolate biscuits with a white chocolate filling! Not bad for £1 - you get 5 packs of 2."

However, Aldi has continued baiting M&S over the legal dispute. It had previously doubled-down on its alleged M&S imitation by paraphrasing one of the retailer's advertising slogans.

It then asked M&S if Colin and Cuthbert could become "besties" and "raise money for charity, not lawyers".

"We’re bringing back a limited edition Cuthbert and want to donate profits to cancer charities including your partners Macmillan Cancer and ours Teenage Cancer. Let’s raise money for charity, not lawyers," said Aldi in a Tweet.."

But M&S rejected the idea and told Aldi to use its "own character".

"Hey Aldi," replied M&S in a tweet. "We love a charity idea (Colin's been a BIG fundraiser for years). We just want you to use your own character. How about #kevinthecarrotcake? That idea's on us... and we promise we won't do Keith."

However Waitrose - which has a Cecil the Caterpillar Cake - was keen and tweeted: "Cecil is a caterpillar of the community... count us in!" #caterpillarsforcancer

And now Aldi has continued winding up M&S by using Cuthbert's face to launch its new summer clothing Range slogan - which borrows rather heavily from Nike's slogan, Just Do It.

Aldi tweeted an image of a billboard proclaiming "Aldi's just Done it" to launch the new range, which appears to include branded hoodies, pants, socks and T-Shirts.

It also tweeted a photo of a model wearing the new hoodie - with Cuthbert's face superimposed over the model's.

"The face of #AldiSpringSummer21. #FreeCuthbert," read the tweet.
