Neighbours complain about rats after rubbish dumped in garden

A Nottinghamshire woman has been fined after failing to clear waste from her gardens.

Ashfield District Council said Zoe Jacques, 26, of Common Road, Huthwaite was given multiple warnings and was subsequently issued with a community protection notice following complaints from neighbours about rubbish dumping, waste and complaints of rats within the area.

Despite these warnings, the council said Jacques did not remove and dispose of the waste in her garden. Continuing to breach her Community Protection Notice she was issued with a fixed penalty notice.

Due to Jacques failing to pay her fixed penalty notice and continued breaches of her community protection notice, the council’s community safety team took action and applied to take the case to court.

Jacques was summoned to Mansfield Magistrates court on January 29, 2021, where she failed to attend. In her absence Jacques was convicted for breaching her community protection notice.

She was fined £200 for failing to comply with the Community Protection Notice, ordered to pay a victim surcharge of £32.00 and costs of £582.44. A total of £814.44 to be paid within 28 days.

Cllr Helen-Ann Smith, Cabinet Member for Community Safety said “Zoe Jacques showed total disregard for her neighbours and the environment. She was given plenty of opportunity to clear the waste from her garden but chose to ignore warnings issued to her. A problem that was easy to fix has now resulted in a costly fine.

“This case should act as a warning to all those that think it is okay to dump waste in their gardens and get away with it. The Council is committed to dealing with anti-social behaviour and those that think they can get away with it.”
