Neighbourly dispute over noise levels results in man being cautioned and charged

A dispute between neighbours over noise levels resulted in a man being cautioned and charged by police officers.

Justin Fullarton, 45, of Annpit Road, Ayr, appeared at the town’s sheriff court on Wednesday, December 4.

He admitted behaving in a threatening or abusive manner likely to cause a reasonable person to suffer fear and alarm in that he did repeatedly stare into the home address of Maureen Barrie and repeatedly shout and swear in Annpit Road on August 29 this year.

Fiscal Depute Laurin Campbell said: “The complainer resides directly across the road from the accused. In the early hours a noise complaint was dealt with in the area by the police.”

The court was told how Fullarton came into the street on two occasions and shouted to his victim “you’re a f*****g grass.”

Fullarton’s victim felt “intimidated” and thought it was about the noise complaint.

Police attended and Fullarton was cautioned and charged.

Defence solicitor Ian Gillies said: “The complainer used to be a friend of his but a closer friend of his girlfriend. They used to have drinks and parties. There was a breakdown between the complainer and the accused’s girlfriend, it’s pretty childish and he accepts that he behaved in that manner. There’s been no trouble (since) not will there be.”

Sentence was deferred on Fullarton for 12 months and he was ordered to be of good behaviour.
