Nearly a dozen drivers hit with the same penalty by gardai for dangerous but common law break

Eleven drivers were hit with the same penalty after Gardai carried out checkpoints across Naas, Newbridge and Clane recently.

According to officers, every driver on this occasion was pulled by the Naas Roads Policing Unit for using their phones while driving and now must pay up the fines associated with this rule break.

In a post on Twitter police warned that: “Distracted driving causes collisions. Safe driving requires your full concentration at all times.

"Naas Roads Policing Units issued 11 FCPNs to drivers using their phones while driving, including 2 taxi drivers in Naas, Newbridge and Clane recently."

An Garda Síochána had issued more than 21,000 Fixed Charged Notices to drivers for using a mobile phone while driving by the end of 2021.

The current laws state that it is an offence to hold a mobile phone in your hand, or to support it with another part of your body - between your head and shoulder - while driving.

Officials say the only exception is if you are calling emergency services on 999 or 112.

It is an offence to access information on your phone while you are driving, even if your phone is secured into a hands-free system.

You can legally talk on your phone using a hands-free system, but the Road Safety Authority advises very strongly against this.

The sanction for anyone on the phone while driving is a fixed charge of €60, and 3 penalty points.

However, this increases to a fixed charge of €90, and 5 penalty points if it goes to court because of non-payment.
