Naperville votes to settle police lawsuit

Oct. 22--Naperville's City Council voted Tuesday to authorize an out-of-court settlement in a lawsuit connected to a Naperville police officer striking two pedestrians with his cruiser in 2008.

The city will pay $643,750 to plaintiffs Carolyn Marszalik and Stephen Sokoloski, and $25,000 to plaintiff Steve Ellis, according to the settlement agreements.

The lawsuit was filed in 2009 in DuPage County. It stems from an incident in October 2008 when Kenneth C. Keating, a Naperville police officer, allegedly struck Marszalik and Ellis as they were crossing the street at the intersection of Main Street and Aurora Avenue, according to legal records.

Marszalik and Sokoloski were married at the time, according to the lawsuit.

Sokoloski was a plaintiff in the case due to the impact Marszalik's injuries had on him, according to Steve Berman, the plaintiffs' attorney.

Marszalik suffered a left femur fracture and subsequent health complications, Berman said.

Keating, who joined the force in 1994, remains with the department, according to officials.

"We were very pleased with the settlement in this case," Berman said. "It was a long road."

The settlement vote was not discussed by City Council members before it was voted on with other items in the consent agenda.
