Mylan won't testify at EpiPen hearing

PITTSBURGH _ Mylan executives will not testify at a Nov. 30 Senate judiciary committee hearing over the EpiPen, citing the U.S. Justice Department's refusal to testify.

"Mylan respectfully declines the invitation to testify," Mylan's lawyers, Latham & Watkins, said in a letter dated Friday and released Monday by committee chairman Sen. Chuck Grassley.

Grassley, R-Iowa, had called the hearing to examine the proposed $465 million settlement with the Justice Department for overcharging Medicaid for the EpiPen emergency allergy shot. The senator and others have criticized the deal as too soft on Mylan.

Earlier this month, the Justice Department said it would not attend the hearing, saying it could not comment on any pending matters and investigations.

"The Obama administration is dodging accountability for an expensive problem and now a company is following its bad example," Grassley said in a statement.

"One way or another, I intend to get answers for patients and taxpayers."

The committee is deciding whether to reschedule the hearing, possibly with subpoenas to the witnesses, Grassley's spokeswoman, Jill Gerber, said in an email.

Mylan has its operational base in suburban Pittsburgh.
