Mum who suffered brain injury in attack by son asks judge not to jail him

A mum who was assaulted by her son urged a court to impose treatment for his mental health.

Darren Shephard attacked his mother Gillian, 66, when he visited her at her home in Acacia Avenue, Staple Hill.

Bristol Crown Court heard she sustained a minor trauma brain injury, a 3cm laceration to her forehead, swelling to her collar bone and a fracture in her arm.

Shephard, 35, of Jamaica Street in Kingsdown, admitted assault occasioning actual bodily harm (ABH) after the incident on October 15, 2019.

He slammed his mum on to the floor

The court heard he suffers from psychosis and depression after long-term alcohol and cannabis use.

Susan Cavender, prosecuting, said Shephard became angry before lifting up his mum and slamming her to her hall floor.

Both she and Shephard reported the assault to police, the court heard.

Nicholas Lee, defending, told the court: "Were it not for his complex underlying condition, this offence would not have happened."

Mr Lee said his client's aim was to recover, get back into work and re-establish links to his family.

'I love him and I only want the best for him'

As he was sentenced on March 11, a judge heard a statement from his mum in which she said: "Prison would not help my situation in dealing with him.

"I hope he can be given help.

"I love him and I only want the best for him.

"I only want help so I can help him."

Judge Michael Longman handed him a six-month prison sentence, suspended for two years.

He told Shephard: "It is a serious case.

"It is serious because of the injuries on your own mother in her home.

"I've no doubt what happened is very much associated with your mental health at the time."

Shephard was handed a Mental Health Treatment Requirement for 12 months and 10 days of rehabilitation.

He was also given a two-year restraining order forbidding him direct or indirect contact with his mum or visiting her address.
