Mum sues gym after 98kg weight fell on son and crushed him to death during work out

A devastated mum is suing a gym after her teenage son died crushed under a 98kg bar weight while working out.

Ben Shaw, 15, was training alone at the Pine Rivers PCYC gym in Brisbane, Australia, when the weight fell on his throat.

He allegedly suffered serious injuries in the accident which took place in September 2017.

The teenager was reportedly trapped under the equipment for up to 30 minutes and was later rushed to hospital.

He died in hospital three days later when his family decided to turn off his life support.

Ben's mum Dalya is now suing against the Queensland PCYC, hoping the incident will never be repeated, the Daily Mail reports.

Dalya told the Sunday Mail: "I want to invoke change and prevent another family's lives from being turned upside down and going through what I have and continue to go through.

"What has happened is not OK and never will be OK, regardless of any legal outcomes."

Work Health and Safety is already prosecuting Queensland PCYC and it could take years to reach an outcome.

Dalya described her son as her best friend and said she was "completely devastated" by his tragic death.

She has filed for more than $581,000 in damages and alleges in her District Court claim that Queensland PCYC breached its duty of care.

She also alleges a lot of procedures were either not in place or not followed, including the lack of supervision.

No defence has been filed and no hearing date has been set.  

At the time of the incident, PCYC Queensland Board chair Garry Humphries said words were “not enough to describe the sadness we feel for the Shaw family”.

“We are extremely saddened by the news of Ben Shaw’s passing and our deepest sympathy goes to his family and friends at this very difficult time,” he told local media.

Ben was a keen sportsman and his rugby league and Oztag teammates paid tribute on social media.
