Moped rider breached lockdown and drove wrong way up Scots dual carriageway

A man who rode an ­unregistered moped the wrong way down a dual carriageway has been jailed for 14 months.

James Marshall, 24, was also more than one-and-a-half times the drink-driving limit, wearing no helmet and mounted the central reservation on the borrowed bike.

He was branded "stupid" by the sheriff over the incident on Thursday in Methil, Fife.

Prosecutor Sean Maher said: "Officers on foot saw the black moped being driven against the flow of traffic on the wrong side of the dual carriageway.

"It appeared to them it was being driven at speed, weaving in and out, in a side-to-side motion, of the central reservation."

An officer tried to flag the moped down but it didn't stop and mounted the central reservation before making its way against the flow of traffic, narrowly missing a car pulling out of a junction.

When Marshall was apprehended, it was noted that the moped was "in a state of disrepair."

Mr Maher added: "When officers engaged with him his speech was slurred and they detected a strong smell of alcohol."

At Falkirk Sheriff Court on Friday,  Marshall, from Methil, pleaded guilty to dangerous driving, drink-driving, driving without insurance, and being outside his home without a reasonable excuse in the coronavirus lockdown.

He also admitted stealing 12 cans of lager from a shop in the town on May 9.

Martin McGuire, defending, said Marshall had borrowed the moped after drinking a bottle of wine.

Imposing the jail term and banning Marshall from driving for 16 months Sheriff Alastair Brown said the lockdown rules were clear.

He said: "He wasn't taking exercise because he was on a moped and it couldn't be said he was staying alert even though he was outside his home."

"You very clearly have a serious drink problem and if you don't do ­something about it you're going to kill yourself.

"Unfortunately, given the way you behaved, there is a serious chance of you killing somebody else as well."
