Cohen revealed that by October 11, he and Davidson had already reached an understanding on the terms of the settlement. This included the agreed-upon sum of $130,000 and a notable liquidated damages clause of $1 million per violation. Cohen claimed that the idea for the $1 million damages clause originated from him.
