A 39-year-old man accused of raping a woman they found sitting on a Brisbane city bench has been granted bail, while his teenage co-accused has been kept behind bars.
The man, who cannot be named for legal reasons, appeared by video-link from the Brisbane Magistrates Court watch-house on Friday after his arrest the previous day.
The Brisbane tertiary student and an 18-year-old co-offender are charged with rape and deprivation of liberty.
Police will allege they have CCTV footage showing men approach the 20-year-old woman, who was intoxicated and sitting on a park bench on Brisbane's Albert Street, early on Sunday.
The men allegedly took her to the Brisbane Botanic Gardens and raped her.
It is also alleged they returned after she had passed out in the park and asked for the banking password for her phone, but she grabbed the mobile and walked away.
Another man helped the woman get to hospital after she came out the park a few hours after allegedly being taken in by the men.
Opposing the older man's release on bail on Friday, police prosecutor Senior Constable Min Hu said the man was at risk of endangering people.
"The defendant has shown rampant disregard for the liberty and respect of another person," he said.
"It is alleged he has taken advantage of an intoxicated female."
The man - who has no criminal history - was an African refugee for almost 20 years and is now studying in Australia, Legal Aid lawyer Megan Bowie told the magistrate.
She said identification evidence was incomplete and medical evidence not yet available.
Magistrate Janice Crawford granted the man bail, ordering he adhere to conditions like reporting to a police station three times a week.
The 18-year-old co-accused was refused bail on Thursday.
He has been remanded to appear in the same court on November 1, while the older man is due to have his case mentioned again on October 11.
