McDonalds, Burger King or KFC drive-thrus could leave you with a £200 fine

Drivers caught using their mobile phones at fast food drive-thrus could be in for a nasty shock under tough new rules.

Penalties have come into force which could see drivers fined without realising they have committed an offence.

People seen holding their mobile phones while driving will be handed six penalty points and a £200 fine, Essex Live reported.

Previously the punishment was three points and a £100 fine.

But now police in Manchester have been asked if using Apple Pay for purchases could land motorists in hot water.

Jay Chase asked on the social media site if he could use Apple Pay at McDonalds drive-thru without losing his license.

If the car engine is off and the handbrake is applied then motorists will escape a fine, police admit.

But there is one scenario where drivers could be prosecuted.

GMP Traffic said ot Twitter : “If your engine is off and your handbrake applied and you’re parked yes. If your engine is on NO.”

Currently, it is illegal to use a hand-held phone or similar device while driving or riding a motorcycle - and the rules are the same if you’re stopped at traffic lights or queuing in traffic.

UK law states that you can only use your phone in a vehicle if you need to call 999 in an emergency.

But if caught using your phone behind the wheel, you could end up with six penalty points on your licence and a £200 fine.
