Man who shook baby violently caused permanent brain damage and refused to admit it

A man who shook a seven-week-old baby so violently he has suffered permanent brain damage has now been jailed.

Joshua Moody, 25, from Wakefield previously refused to admit to the crime and "catastrophic injuries" he inflicted.

This continuous denial actually led to the boy's mum and his grandmother being arrested instead.

The boy's mum has now described the ordeal, which went on for four years, as a "nightmare".

Moody was jailed back in May for three years, but this can only be reported now because the court order has lifted.

Such horrifying abuse means the baby will now have to have 24/7 care for the rest of his life, Leeds Crown Court heard.

The young boy was found unresponsive at a property in Wakefield, West Yorkshire by emergency services back in summer, 2017.

After suffering a cardiac arrest he was rushed to hospital then transferred to the paediatric intensive care unit in Leeds General Infirmary.

Doctors found he had suffered multiple severe injuries, including bleeding behind his eyes and on his spine as well as a number of broken ribs and a fractured spine.

Experts concluded that "life-threatening abuse" was the only explanation.

Prosecutor Craig Hassall said a lot of the boy's injuries were consistent with violent shaken and many were inflicted before he had the cardiac arrest.

His family were told they may need to prepare for the worst after the attack, but he managed to start breathing on his own again.

He has however been left severely disabled, with epilepsy and cerebral palsy. He can't move or speak, and suffers from impaired hearing and vision.

Moody claimed the injuries were caused by "rough handling" and motivated by a "flash loss of temper".

Earlier this year, he was due to stand trial after being charged with GBH with intent. But later he admitted to GBH without intent.

The boy's mum, who cannot be identified for legal reasons, said in court: "As a family we were all under suspicion. Josh maintained his innocence throughout. By maintaining his innocence, he was inferring I had to be responsible for what had happened.

"The fact is Josh could have prevented this by admitting his responsibility on any number of occasions.

"The actions of Josh are terrible and inexcusable."

Mitigating, Christopher Dunn said: "He is absolutely heartbroken that he could do this.

"That may not resonate with the family, but he has to live with this for the rest of his life."

Judge Belcher, at the sentencing on May 17, said: "The injuries are such that he will be impacted for the rest of his life.

"You did this and knew you had done it and you could have saved an awful lot of people a great deal of additional suffering.

"I accept that you did not set out to cause these terrible, terrible injuries, but these matters could have been explored much sooner if you had the guts to admit what you had done."
