Man who killed sister on way to hen party when trailer overturned is spared jail

A brother who killed his sister on the way to her hen party when the trailer he was driving overturned has been spared jail.

Patrick Schwarnthorer, 26, was found guilty of the involuntary manslaughter of his sister Jasmin, 26, near their family home in the town of Allhartsberg, Austria.

But pleas from his family and lawyers and spared him jail and he was instead sentenced to a suspended ten-month prison sentence and a €9,000 (£7,786) fine.

Jasmin Schwarnthorer was setting off from her family home for her hen party with 13 friends, and was due to wed fiancé Bernhard the following month.

She was standing in a tractor-pulled trailer, which was being driven by her then-25-year-old brother, when the trailer suddenly flipped over on a corner.

Patrick, who had made the trailer himself, admitted he was driving too fast.

Jasmin hit a stone wall as she fell from the trailer and was airlifted by helicopter to a hospital in the city of Linz in critical condition.

She died from her head and chest injuries a few days later. Five other women were also severely injured, while another seven suffered minor injuries.

His mother wrote a touching message to her deceased daughter in her book of condolences before the start of the trial, saying: "Please help your beloved brother, especially today."

Patrick had been warned that he could expect to spend three years behind bars.

The court heard how the trailer had only one axle and should not have been used to carry people on the road.

Police chief Johann Baumschlager said: "The transport was illegal. The vehicle can only be used in agricultural operations or in the forest."

Patrick himself told the court he had been driving too fast due to the "situation dynamics", saying: "Everyone was in a good mood."

His lawyer said it had been a "tragic accident" and said the injuries of those standing on the trailer would not have been so severe but for the stone wall.

The lawyer added: "The defendant has already received the true punishment. This is one of the few cases where not only the victims are pitiful, but also the perpetrator."

And the prosecutor agreed, telling Patrick: "From a human point of view, I think you have already been punished enough."
