Man who grabbed passenger's genitals in train station toilet claimed he'd 'tripped'

A man who grabbed a male passenger’s genitals in the toilets of a train station claimed he’d “tripped”.

Barry Smith, 43, must sign the sex offenders register and pay his victim £650 after the incident.

The victim, who is in his 40s, said Smith had grabbed his genitals with the force of a “strong handshake” in a “fleeting but deliberate” movement.

Smith, from Windsor Road in Penarth, Vale of Glamorgan, denied sexually assaulting the stranger but was found guilty after a trial.

He wore a suit and face mask as he was sentenced by a judge on Thursday over the incident.

The court heard the assault took place in the toilets of Waterloo station in London on November 29 last year.

Sentencing him, District Judge John Zani said: “You were found guilty after trial of sexual assault on a stranger in the toilets at Waterloo station, which you denied.

“You denied it at the time and you still deny it. He describes the level of force as akin to a firm handshake which came into contact with his genital area.

“He describes it as being fleeting but deliberate in nature. You said you tripped and may have made contact but not in the way suggested.

“Your defence was rejected at the trial and you were convicted.”

Smith was found guilty at Hendon Magistrates’ Court on September 3. At Westminster Magistrates’ Court on Thursday he was given a community order and required to carry out 20 days of rehabilitation over the next year.

He was fined £640 and must pay a victim surcharge of £112. The victim will also be paid £650 in compensation.

Smith was also ordered to register as a sex offender for the next five years.
