Man tells court he was over alcohol driving limit after celebrating his birthday

A Speedwell man told a court he was unwittingly twice over the drink driving having celebrated his birthday.

Juris Dnistrjans said he was driving his Audi to work at 6am on October 21 after boozing the day before.

He told Bristol Magistrates' Court he didn't expect his alcohol level would be at the reading police found.

Dnistrjans, 31, of Heathcote Walk, pleaded guilty to driving an Audi in Lodge Causeway and Fishponds Road when he was over the alcohol limit.

Police found he had 70 microgrammes of alcohol in 100 millilitres of breath. The limit is 35.

Sian Hunt, prosecuting, told magistrates it was around 3.55am when police spotted Dnistrjans driving a silver Audi at speed, veering to the wrong side of the road.

Police stopped the car on Fishponds Road and conducted a roadside breath test before taking him to Patchway police station where he provided the breath test.

Dnistrjans, representing himself, said he had been celebrating his birthday the day before and he had to drive to work at 6am on the day he was stopped.

He said he had not expected to be at the alcohol level he was found to be, accepted his guilt, and asked not to be banned as he needed to drive to work.

Magistrates said the incident was a lesson of life for the defendant and he needed to leave a bigger gap between drinking and driving.

They banned him from driving for 17 months but said a drink-driving course would get him a 129-day discount.

He was fined £323 with costs of £85 and a victim surcharge of £32, to be paid from December 13.
