Man sentenced over tattoo parlour drive-by

A man who helped shoot up a Melbourne tattoo parlour in the middle of the night and then set fire to the evidence has been spared further jail time.

Mustafa Yuksel pleaded guilty over the drive-by shooting of the City of Ink, owned by former Richmond AFL player Jake King and underworld figure Toby Mitchell, at South Melbourne in July 2018.

He then helped set fire to the stolen car used in the shooting before being arrested with his getaway driver.

Yuksel was sentenced in Victoria's County Court on Wednesday to 27 days' jail, already served, and a 30-month community correction order.

The 27-year-old admitted theft, using a firearm in a public place, arson and drug possession.

Judge Sarah Leighfield said sending Yuksel back to prison would be counterproductive, given the strides he'd since made to turn his life around.

A gun was found in the ruins of the car set alight at Brunswick after the tattoo parlour shooting.

Yuksel and another man were soon pulled over in a different car, driven by associate Hakan Akbal, with the headlights off.

It smelled strongly of petrol and a jerry can was found in the back seat, alongside gloves with Yuksel's DNA on them.

He also had gunshot residue on his hands. Comancheros bikie clothes and testosterone vials were later found at his home.

Prosecutors could not prove who exactly fired five shots into the tattoo parlour, but Yuksel admitted he was complicit in the plan.

His lawyer, Cynthia Lynch, said the-then 24 year old's arrest spurred him to turn his life around.

Ms Lynch said the 27 days Yuksel had spent in custody before being bailed "effectively terrified" him.

The lawyer also described the offending as a one-off and said the courts were unlikely to see Yuksel again.

He's now expecting a child with his wife.

Yuksel must perform 200 hours of unpaid community work as part of his court order. He's also been fined $500 for drug possession.

Akbal was in August spared jail for his role in setting the drive-by car alight following the shooting and then driving Yuksel away.
