Man offered illegal tooth whitening after already being fined £9,000

A man appeared in court for practising dentistry while not lawfully able to do so.

Wayne Roberts, 58, failed to register with the General Dental Council (GDC), making the teeth whitening he carried out illegal.

It is the second time he has appeared in court for unlawful dentistry, having been convicted of similar offences in 2014 for which he was fined £15,000.

Following an appeal the fine was reduced to around £9,000, Liverpool Magistrates' Court heard yesterday.

Roberts appeared in the dock on Thursday over allegations he unlawfully practised dentistry on two women at Moreton, Wirral.

At a previous hearing, Roberts admitted the two counts of whitening teeth while not registered as a dentist or dental care professional.

Sarah Griffin, prosecuting, explained that Roberts had previously admitted the offences on the basis that he did not accept unlawfully using the title of a dentist.

Ms Griffin explained Roberts had faced similar convictions previously, which took place at the Caldy Clinic Wirral practice on Banks Road, West Kirby, and at the firm’s Liverpool city centre base on Rodney Street.

Roberts is again being prosecuted by the GDC as only dentists, dental hygienists, dental therapists and clinical dental technicians working to the prescription of a dentist can carry out tooth whitening.

Dental technicians must also be registered with the GDC to work in the UK.

Roberts, of Bridge Street in Kington, Monmouthshire, did not have representation at yesterday's hearing but asked the court to consider moving proceedings closer to his home as he said he had to break lockdown restrictions to arrive.

The court's legal advisor confirmed that he has not broken restrictions by attending court on Thursday, but suggested he may wish to make an application ahead of the next hearing to appear remotely.

Roberts will be sentenced at Liverpool Magistrates' Court before a District Judge on November 2.
