Man jailed after battering his way into brother's house and assaulting him as he lay in bed

A man has been jailed for 11 months after battering his way into his brother's house and assaulting him as he lay in bed.

Ross Fowler, 43, turned up at his brother's, in Camelon, Falkirk, at 5.10am.

Prosecutor Kristina Kelly said: "He began kicking at the front door, pushed in a boarded window that had previously been smashed, and made his way in."

He entered the upstairs bedroom where he began shouting and swearing at his brother Gareth, before launching an assault on him.

Miss Kelly said: "He punched him several times on the head and body."

The incident was broken up by two women in the house.

Miss Kelly said the injury caused to Fowler's brother amounted to "a small amount of blood coming from his nose" and medical treatment was not required.

Fowler, of Larbert, appeared at Falkirk Sheriff Court by video link from Low Moss Prison, having previously been remanded, pleaded guilty to hamesucken.

The incident occurred on March 1st, 2020.

Solicitor Mark Fallon, defending, said: "It was a drunken, stupid argument with his brother and he accepts his culpability."

Fowler also admitted assaulting and injuring his then partner, Sheila Reid, in a separate incident outside Tamfourhill Community Centre, Falkirk, on August 31st 2020.

Miss Kelly, the depute fiscal, said: "This was a domestic offence, captured on CCTV and seen by members of the public.

"The accused approached a vehicle, grabbed the passenger by the throat, striking her about the head, attempting to pull her from the vehicle, and kicking her several times.

"The matter was reported to the police and Fowler was identified as the male in the footage."

Miss Kelly said that the passenger - Miss Reid - was left with bruising and a bloodshot eye, but "failed to engage with police."

Imposing the 11-month jail term to cover both offences, Sheriff Christopher Shead said: "Custody is the only appropriate disposal."
