Man involved in Lollipops Playland brawl avoids jail

The footage shows men and women yelling at each other, people being thrown on the floor, while young children cried.

A sixth man involved in a violent brawl at a children's birthday party in Sydney's south-west has avoided jail.

Aduard Aushana, 61, appeared before Fairfield Local Court today and was sentenced to 18 months in prison.

However, instead of being placed behind bars Aushana will instead serve the sentence in the community under an Intensive Corrections Order (ICO).

Another man involved in the fight will appear in court next month.

The fight broke out at a six-year-old girl's party at the Lollipops Playland at Wetherill Park in Sydney's west in June.

It went on for about five minutes and was captured on video.

The footage shows men and women yelling at each other and people being thrown on the floor while young children cry.

The court earlier heard the fight broke out because one of the offenders pulled a girl's hair after she bumped into another child on the centre's slide.

When the girl's father asked the man what happened, he was then attacked by the man and his relatives.

Aushana and five of his relatives, as well as a woman from the same extended family, pleaded guilty to assault and affray in October.

All men will serve their sentences, ranging between 18 and 20 months, as ICOs, while the woman, Marlene Issac, was handed a 12-month suspended sentence in December.

While handing down Aushana's sentence Magistrate Vivien Swain described him as the "senior member" of the offending family.

"The victims were there celebrating the party of a four-year-old," she said.

"A terrible fight broke out in a place where little children play and celebrate special occasions."

She said the seriousness of the offence meant a prison term was the only appropriate form of punishment, however, Aushana was suitable to serve his sentence by ICO.
