A man struck by a passing vehicle during a police pursuit north of Byron Bay has died.

The man failed to stop and headed north from the famed beach town when police tried to pull him over about 5.40pm on Thursday, due to the manner of his driving.

Road spikes deployed about 35 kilometres north of Byron Bay at Cudgera Creek burst the tyres of the car.

He continued another five kilometres to Cudgera Creek before stopping.

After he exited the vehicle, he was struck by a passing vehicle

The man died at the scene and is yet to be formally identified.

The incident will be investigated by police from a separate district.

That investigation will be subject to an independent review and all information will be provided to the coroner, police said.
