Detectives have charged a 34-year-old man with murder and breaching a domestic violence order over the death of a woman whose body was found burned in a backyard on the Gold Coast.

The New Beith man remains under police guard in the burns unit of the Royal Brisbane and Women's hospital and the charges will be presented to the Southport Magistrates Court on Wednesday in his absence.

Formal identification continues after the woman's body was found in the garden of a Spikes Court home on Tuesday morning, but police believe it to be 27-year-old Kelly Wilkinson, who lived there.

Police closed off the court after being called to the home at 6:40am for a welfare check.

Detective Inspector Chris Ahearn said police found the woman's body in the backyard of the property.

The man, who was believed to have been known to the woman, was found later in a "semi-conscious" state on the front lawn of a property two blocks away at Langer Place, he said.

A second crime scene has been established at that property.

Three children under the age of nine were present at the house where the woman was found and have been taken into care.

Forensic Police catalogued the crime scene at the woman's house and another at the property where where the man was found.
