Man charged after spitting at Glasgow Subway staff during coronavirus lockdown

A man has been charged after spitting at Glasgow Subway staff during the coronavirus lockdown.

British Transport Police confirmed the incident which took place on Thursday (March 26), with the charge being increased to culpable and reckless conduct on account of the new laws introduced as a result of the Covid-19 crisis.

The BTP Ops Support Unit Tweeted: "Report of spitting at Glasgow Subway station staff on 26th March.

"D Division West OSU have the male identified and charged. Increased to 'Culpable and Reckless Conduct' due to the Covid-19 pandemic.

"Keyworkers do not deserve this. SPIT=FACE THE CONSEQUENCES."

As Glasgow Live reported over the weekend, culpable and reckless conduct is deliberate conduct that exposes an individual, or the public generally, to significant risk to life or health, according to the crime.scot website.

As the name of the crime suggests, the conduct has to be reckless. This means acting with a complete disregard of (or indifference to) the consequences of his/her actions. You cannot commit this crime accidentally or carelessly.

There’s no requirement for actual injury to have been caused; the offence is the exposure to risk.

The test is an objective one, so it’s whether the risks inherent in the actions in question would have been clear to the reasonable person.
