Man bit and spat at Sainsbury's security guard in 'gross' attack

A man spat at and bit a Sainsbury's security guard after an argument broke out at the store.

The incident occurred at the Sainsbury's shop in Waverley Street in Nottingham, Nottingham Magistrate's Court was told.

David Robinson, 27, of Clumber Street in Sherwood Rise, Nottingham, carried out the "gross" attack on security on October 15 last year.

The court heard that an argument started between Robinson and a female outside the shop.

Rebecca Williams, prosecuting, said: "The security guard went round to the front of the store and tried to intervene and calm the matter down.

"The defendant came up the ramp towards him and so he tried to close the gate to try and keep the defendant from himself and the female. However, when the defendant reached him he has bitten him on his arm and spat in his face. The spit landed on his cheek."

The court was told the bite did not break the man's skin as the security guard was wearing a jacket.

Deputy District Judge Monroe told Robinson: "This was a man trying to do his job at a supermarket trying to help. To be assaulted and spat at any time is absolutely gross but when we are where we are at the moment within a pandemic it is even more so."

Ms Wybourne, mitigating, said: "This is out of character, he flinches every time you talk about it and he obviously does show remorse for the incident - he is quite mortified.

"He did go back to try and make amends and apologise to the security officer. He had consumed alcohol which had affected his inhibitions on that day."

The court was told that since the incident, in February 2021, Robinson had been hit by a vehicle while he was on his mobility scooter.

He was taken to the major trauma unit at the hospital and has lost part of his hip as a result of the collision.

"The accident has had a marked impact on his life," said Ms Wybourne.

David Robinson pleaded guilty to assault by beating and was handed a 12-week prison sentence, suspended for 12 months.

He was also ordered to undertake 20 rehabilitation days and pay £150 in compensation to the victim, as well as a surcharge of £128.
