Man assaulted woman after being told to leave flat

Pushing a woman over landed a man with a 12-month community order.

Paul Holley pushed Ann Murdoch after being told to leave accommodation in Weston-super-Mare.

Bristol Crown Court heard at the time he was serving a previously suspended jail term for wounding.

Holley, 57, of Highbridge, was convicted by magistrates of assault after the incident on April 12.

Judge William Hart handed him a 12-month community order with up to 25 days' rehabilitation on Wednesday, October 28.

He told Holley: "Your case was sent to Bristol Crown Court because the offence was during the currency of a suspended sentence.

"It is my view that is it not necessary to lock you up today."

The judge fined Holley £50 and handed him a five-year restraining order to keep away from named persons and places.

Neil Treharne, prosecuting, said Holley was told to vacate a flat and an argument ensued.

It culminated in him pushing Ms Murdoch to the ground, leaving her with pain to her collar bone and wrist.

Ehsan Oarith, defending, said there appeared to be a common theme to his client's offending, involving disputes at his accommodation.

Mr Oarith told the court: "If it was not for the prospect of being homeless that day he probably would have left.

"The choice he had was to be arrested or stay where he was in the middle of lockdown."
