Man accused of raping woman found 'semi-conscious' on footpath refused bail

One of two Melbourne men accused of raping a "semi-conscious" woman in their car after offering her a lift home has been refused bail over concerns he will reoffend.

Jarrod Thomas, 23, and 26-year-old Harley Palise were driving home when they allegedly spotted the 33-year-old woman lying on the footpath on Lygon St, Carlton, in the early hours of June 17.

She appeared "semi-conscious" and was not in a state to consent, police earlier told the Melbourne Magistrates' Court.

The men are accused of offering her a lift home, before she was helped into their car and driven to Coburg where they allegedly raped her multiple times.

The pair also allegedly stole the woman's $16,000 engagement ring, which was missing when she was eventually dumped outside her house.

Magistrate Andrew Cappell said the prosecution had painted a picture of two young men taking advantage of a vulnerable stranger.

"In other words, acting like predators on a weak, unsuspecting and vulnerable complainant," he said.

"The sheer randomness of this alleged behaviour raises grave concerns for me that if released on bail [Mr Thomas] would reoffend."

Mr Cappell refused Mr Thomas' bail application which he had made with the support of 25 character references and a $250,000 surety for bail.

The woman had been out with a friend in the city on the night she was allegedly attacked.

The court heard Mr Thomas allegedly said the woman had "looked just not there, just like all spaced out … she literally passed out".

He is also accused of describing the woman as looking like "she's just come off some heavy drugs" when he first saw her.

Mr Cappell said there was strong forensic evidence linking Mr Thomas to the alleged rape.

"There is a strong prosecution case which suggests he has preyed on … a vulnerable women and taken advantage of that vulnerability in the most vile manner," he said.

As well as facing three rape charges, Mr Thomas is charged with abduction, false imprisonment, unlawful assault and theft of the woman's diamond engagement ring.

He faces a maximum 25 years' jail for rape.

Mr Cappell told the court if Mr Thomas was found guilty, the length of his jail term would be "very significant".

Mr Palise is in custody and faces two counts of rape, as well as abduction, false imprisonment, unlawful assault and theft charges.

The men will return to the Melbourne Magistrates' Court later this month.
