Man accused of making threats to kill argues alleged victim is a 'mad ice addict'

A Canberra man accused of threatening to kill his girlfriend and her son has told a magistrate the woman is a "mad ice addict" who "lured" him to their home.

The 48-year-old - who cannot be named for legal reasons - fronted the ACT Magistrates Court on Monday, charged with trespassing, damaging property, and making a reckless threat to kill.

His defence lawyer said the 48-year-old man had his own methamphetamine addiction.

The accused told Acting Chief Magistrate Glenn Theakston he had "no risks" of re-offending if he was released on bail. He did not enter pleas to the charges, but said he did not trespass at his girlfriend's house.

Police documents tendered to the court said the man ran into his girlfriend's son at Chisholm shops on March 7, 2020. The 48-year-old man went to the son's house, which he shares with his mother.

The man left the house about 5pm after a "disagreement" with his girlfriend, but allegedly returned about 9.20pm and yelled "unintelligibly" while trying to kick in the house's front door until it fragmented. He later tried to get into the house through a window, the documents said.

The documents said the man yelled to his girlfriend and her son that he would kill them both and "come in and get rid of" them. The woman's son later told police the 48-year-old told him he was "a dead man", and that he would make them "disappear" when he got inside their house.

"[The man's girlfriend] was terrified the defendant would get in the house and carry out his threats," the documents said.

The accused told Mr Theakston a different version of events in court on Monday. He said he'd organised to meet his girlfriend in a public place, but she asked him to come to her house for coffee instead.

He said: "She had no sugar ... what does that tell you?

"She knows what's in her cupboards.

"It's like she lured me [there] to be set up."

The man said his girlfriend was a "mad ice addict" who "threatened him with bikies", and told Mr Theakston: "I'm going to be dead anyway."

Police arrested the man about 9.35pm on March 7.

He told Mr Theakston he did not want to go near his girlfriend's house if he was released on bail. His defence lawyer said he was on a good behaviour order at the time of the alleged offending.

Mr Theakston said the man was accused of a "serious example of threatening behaviour", and refused him bail to appear in court again later this month.

Mr Theakston said no bail conditions could ameliorate the man's risk of re-offending.
