Man accidentally knocked woman's tooth out with vodka bottle during squabble at party

A partygoer accidentally knocked a woman's tooth out with a bottle of vodka during a jealous squabble.

Carlos Bernard was put on probation for a year when he appeared at Nottingham Crown Court after the incident which left her saying: "I feel so ugly."

The court heard that the woman invited the 60-year-old to the party on July 14 and drinking went on all day.

Leanne Summers, prosecuting, said: "They began to argue. He accused her of flirting."

Bernard had a bottle of vodka in one hand and this caught her in the face, knocking out the tooth.

Miss Summers told the court: "He poured the bottle of vodka over her. Somehow both ended up outside in the garden where the defendant grabbed her around the throat before he walked off."

When questioned later, Bernard said that he "didn't intend to connect the bottle with her face."

In a statement a month later, the woman said she was unable to eat for two days. A NHS dentist said she would need root canal work to insert a tooth.

Bernard of The Wells Road, Mapperley, denied assault by beating but was found guilty by magistrates, who sent the case to the crown court.

In their ruling, the JPs said they felt that he used "excessive self-defence and that his actions were reckless as opposed to deliberate."

Ms Shital Maher, mitigating, said: "There was a lack of premeditation and excessive self defence.

"There was an argument between the two of them. He grabbed her arm and she pushed him down.

"In his right hand was the vodka bottle."

She said that Bernard had suffered five heart attacks, the most recent in 2018. He also has mental health problems and curvature of the spine.

Judge Martin Hurst ordered Bernard to pay the compensation at a rate of £20 a fortnight. It will be taken from state benefits.

He said that Bernard and the woman had been drinking and told him: "The argument was based on jealousy."

Bernard was also ordered to pay the woman £250.

During a year on probation, Bernard must attend 15 sessions to directly tackle his problems.
