Man, 37, breached restraining order and turned up at his ex-girlfriend's house because he ‘saw a man on her drive’ - he'd previously threatened to set her on fire

A man breached a restraining order which was imposed just four months earlier after he turned up at his ex-girlfriend’s house because he ‘saw a man on her drive’.

Gilson Paiva, 37, had previously been banned from contacting his ex after threatening to set her on fire.

He had previously attended her house and cut the internet cable, Manchester Crown Court heard.

However, just four months after being handed a suspended sentence, Paiva, of Salford, turned up at her house again whilst the woman was sitting down for a meal with their children.

The couple got into an argument as she told him he couldn’t be there, and he resorted to throwing her bottles of alcohol down the sink and binning their meals.

Paiva pleaded guilty to harassment, breach of a restraining order and breach of a suspended sentence.

Yesterday he was handed another suspended sentence.

Prosecutor Damian Nolan told the court that on June 29 of this year, an altercation took place between Paiva and his ex-partner when he turned up at her home unannounced.

“The children were having an evening meal and so witnessed the altercation,” he said.

“He took bottles of alcohol and drained them down the sink and took their food and put it in the bin.

“Tempers were frayed to say the least.”

The woman tried to call the police numerous times but Paiva repeatedly took the phone from her hand.

When the police eventually attended, the officer could see the children were in distress, and one held their arms out to give her a hug.

The child told the officer that his dad had ‘unexpectedly turned up’ and he was scared as he had previously seen his father hit his mum.

After he was arrested, he was interviewed and laid blame on his former partner.

“He said he turned up because he saw a male was on the driveway - it was a male friend,” Mr Nolan said.

“He said he was concerned as his children were in the family home.”

Paiva was said to have a number of previous convictions including threatening behaviour, criminal damage and harassment.

In the majority of the offences, his ex-partner was the victim.

Mitigating, Estelle Parkhouse said her client has been in custody since June 9 when he was arrested, which would mean he had served the equivalent of a four month sentence of imprisonment.

“The account he gave in the interview was the account he gave to me in conference,” she said.

“He was driving past the complainant’s address when he saw the man walking to her house.”

Sentencing him, the judge, Recorder Ciaran Rankin said: “I don’t accept for one moment that it was merely a coincidence in which you were passing and were concerned.

“This was a deliberate act on your behalf and a deliberate breach of the court order.

“This took place in front of your four children and it was quite clear they were in obvious distress.

“You said you had been entrapped and requested to attend - I don’t accept that for one moment.

“It was a deliberate and clear set of lies.”

Paiva, of Weaste Lane, was sentenced to 12 months imprisonment which was suspended for two years, and was also ordered to complete 20 days of rehabilitation activity requirements and 150 hours unpaid work.
