Mahim drunk driving death case: Mumbai businessman denied bail

MUMBAI: A sessions court has refused to grant bail to a 24-year-old city businessman, Mohammed Shaikh, whose alleged drunk driving at Mahim on May 29 killed a 23-year-old biker and left his 16-year-old sister with serious injuries.

Police alleged that the accused was so drunk when caught that he was unsteady on his feet and his speech was incoherent. The court said that prima facie the medical evidence points towards the fact despite being under the influence of liqour, the accused drove the car and that too in high speed and in a rash and negligent manner. “Prima facie, the ingredients of Section 304(II) (culpable homicide not amounting to murder) of IPC are attracted against the applicant. One person lost his life in the incident and another victim has sustained grievous injuries. Therefore, in view of the above discussion, due to the overwhelming material on record against the applicant, I am not inclined to allow the present application,” the judge said.

Cops had opposed Shaikh’s plea on the grounds that if he is released on bail, the question of law and order would arise in their community. The family of the victim too opposed the bail plea. They said that if granted bail, the accused may threaten and pressurise the witnesses and may commit any other offence against them.
