Maharashtra minister Nawab Malik can get treated at private hospital, Anil Deshmukh can’t

MUMBAI: A special court on Friday allowed NCP leader and state minister Nawab Malik to get treated at a private hospital. “Superintendent of Arthur Road Jail is directed to admit the accused Nawab Malik at Criticare Asia Hospital for taking treatment at his own expenses,” special judge Rahul N Rokade said.

Meanwhile, the court did not allow former state home minister Anil Deshmukh’s application seeking treatment in a private hospital and instead said he should continue his treatment at state-run JJ hospital.

In Malik’s case, his lawyer submitted before court that despite its order last week, he was not admitted to JJ and instead taken to different hospitals and made to travel. “He may be accused in a serious crime but he is entitled to humane treatment,” his lawyer submitted. He said some of the tests and treatment Malik needs to undergo were unavailable at JJ hospital.

The court took serious objection to the fact that despite its orders last week, Malik was not admitted to JJ for the purpose of detailed examina- tion and investigation of his health. “This is very serious. . . how can the court’s orders not be obeyed,” the judge said.

Malik’s lawyer had submit- ted he was suffering from chronic renal disease with bilateral renal cyst, and this could lead to kidney failure. It was submitted that in April, he was advised to undergo sur- gical excision of left renal cyst.

Malik was arrested in February in a money laundering case. In a plea submitted last month, Malik had also said he was suffering from neck pain, lower back pain and heat rashes due to inhuman conditions in Arthur Road jail.

The court in its order also said Malik will be escorted by police and expenses incurred will be borne by him. Malik’s daughter was permitted to remain present during his hospitalisation.

Dean of BMC-run Sion hospital, Dr Manoj Joshi, said Malik had been visiting the hospital for dental work. He had sought gastrointestinal consult on Thursday, he added.

Deshmukh (74) was present in court on Friday. Standing in the witness box, with his arm in a sling, he submitted he was suffering from severe pain in the shoulder. The court directed the jail superintendent to refer Deshmukh to KEM for stress thalium test. “After getting report. . . accused be referred to JJ hospital for treatment for dislocation of shoulder along with report of stress thalium test. Daughter of the accused is only permitted to remain present during hospitalization as per protocol,” the special judge said.

The ED on Monday opposed Deshmukh’s plea seeking transfer to a private hospital, saying all adequate facilities are available at JJ and the incharge doctor performs 30-35 surgeries a year. But Deshmukh’s lawyer submitted he had right to choose hospital.
