Magaluf 'glass attack' victim Sarah Ann Garrity won't press charges against army pal

Scottish soldier Sarah Ann Garrity has told court officials she does not want to press charges against her army pal after being hit with a glass in an alleged attack.

Sarah, from Glasgow, confirmed she is not interested in making a formal complaint against Sydney Cole from her hospital bed today.

The decision means she will waive her right to launch her own private prosecution against Cole - which under Spanish law would run separately but parallel to any state prosecution - as well as the right to any compensation if her pal is found guilty of any wrongdoing after a trial.

Legal experts said they thought state prosecutors would still look to prosecute the 19-year-old if an investigating judge decides there is enough evidence to charge her.

Cole is currently being probed on suspicion of wounding with a dangerous weapon - a crime which in Spain carries a prison sentence of up to five years.

She also confirmed Sarah had decided against pressing charges, even if it does not curb any potential prosecution.

Sarah, who now lives in Middlesborough, is in the Royal Logistics Corps. She reportedly needed 14 stitches to close a cut on her neck caused by the glass.

She was on holiday with Londoner Cole, a 19-year-old who is believed to be in the Adjutant General Corps, and another woman called Deborah Ferguson who is also thought to be a soldier.

Cole has insisted she did not throw a glass directly at Sarah and that her friend was hurt after it broke on the floor.

Sarah told relatives her life “flashed before her” following the 1am incident at Glasgow woman ‘attacked’ in Magaluf to be ‘moved from intensive care’ in Magaluf, which happened after the trio had been on a marathon alcohol bender in the party resort.

The three women were staying at the same hotel in Magaluf.

Cole’s defence lawyer Miguel Angel Ordinas is expected to try to push for his client’s release on conditional bail from Palma prison in the coming weeks while the lengthy investigation continues

Official court sources confirmed on Tuesday that Cole had been remanded in custody after appearing in court.

The source said: “A duty judge on Monday night remanded the young women in prison.

“She is initially being investigated on suspicion of an alleged crime of wounding with a dangerous weapon."
