Madras high court junks contempt plea against DGP C Sylendra Babu; cop imposed cost

CHENNAI: The Madras high court on Friday binned a contempt plea filed by a Grade-II constable against Tamil Nadu DGP C Sylendra Babu and imposed ₹2,000 cost for approaching the court without clean hands.

Justice M Dhandapani passed the order while dismissing the plea moved by S Arunachalam who alleged that the DGP had failed to implement a court order passed in 2019 and consider re-fixing his service seniority. When the plea came up for hearing, additional advocate-general J Ravindran and special government pleader Yogesh Kannadasan submitted that the petitioner had approached the court suppressing facts.

Producing a copy of an order dated September 17, 2021 issued by the office of the DGP, the counsels submitted that the DGP has promptly implemented the court order dated November 26, 2019 and has considered the representation of the petitioner and dismissed the same as not feasible.

However, suppressing the same the petitioner has moved the present contempt petition, they said.

As per the provisions of the Tamil Nadu Government Servants (Condition of Service) Act application for revision of seniority should be submitted within 3 years of appointment, they added.

The petitioner who was appointed in 2005 has made the application for revision of seniority only in 2019, after a delay of 11 years, they said.

Concurring with their submissions, the court dismissed the contempt plea.
