Madhya Pradesh HC gives breather against Indore Municipal Corporation demolition notice for bypass widening

INDORE: Indore bench high court has asked a building owner to approach the Indore Municipal Corporation (IMC) against a civic body notice of demolition of the structure to pave way for widening work of Indore Bypass road.

Justice Subodh Abhyankar disposed of the petition, but gave a breather to the petitioner Sadashiv Yadav, directing that no action will be taken by civic body for 15 days, in case it takes an adverse decision on petitioner’s application, and to allow him to act on remedies available.

Yadav moved to Indore bench of MP high court against IMC’s demolition marking done without deciding his reply over the notice. Yadav in his petition through advocates RS Chabhra and Mudit Maheshwari submitted that he had constructed his office in village Nayta Mundala in 1996 with permission of gram panchayat.

IMC served him a demolition notice on August 25 but before deciding his reply on notice a marking on the building was carried out for demolition, submitted petitioner.

Government advocate Yash Tiwari submitted before the court that no demolition activity shall take place before the petitioner’s reply is decided and if any demolition takes place, it would be in accordance with law.”
