Machete and a cane knife used in fatal attack on brothers, murder trial hears

Mark Miller, 33, died after he was allegedly stabbed with a kitchen knife at a home at Mount Garnet, west of Cairns, in 2018.

Two brothers stabbed in a remote far north Queensland town were driven to an ambulance station before they collapsed in the driveway, a Supreme Court trial in Cairns has heard.

Mark Miller, a 36-year-old father of one, died, and his brother Robert Miller, 33, was seriously injured during the alleged attack at a home at Mount Garnet, west of Cairns, in May 2018.

The pair were driven 2.5 kilometres to the local ambulance station for help by Robert Miller's girlfriend, Tahlia Hinxman, and a paramedic on the scene worked on both of them, the trial before Justice James Henry heard.

The Crown Prosecutor initially said the brothers drove themselves.

Robert Miller, a local mine worker, was flown to the Cairns Hospital and survived, despite multiple stab wounds to his chest, back, and stomach.

Josephine Teresa Bahor, James Deane Blakeway, and Christopher Stephen Hodkinson are on trial, each charged with murder and attempted murder.

The trio — seated at a distance, but together in the witness box — have pleaded not guilty.

On day one of the trial, which began on Tuesday, crown prosecutor Sarah Farnden told the court the Miller brothers had gone to Josephine Bahor and her partner Christopher Hodkinson's home, with each party accusing the other of stealing marijuana from their respective properties.

She said Ms Bahor called the couple's friend, James Blakeway, "for extra muscle" should the brothers return later.

She said the brothers returned about 9:00pm and Robert Miller punched Mr Blakeway in the face.

"Josephine Bahor then attacked Rob Miller and stabbed him with the knife. She also stabbed Mark Miller and the others joined the violence," Ms Farnden said.

She said the trio used an "assortment of weapons" to attack the Miller brothers, including a large knife, a machete, and a cane knife.

Ms Farnden said the brothers "fled to their car" and Ms Hinxman drove them to the ambulance station for help.

Mark Miller died at the scene while his brother was airlifted to the Cairns Hospital and survived.

The Crown told the court Mark Miller had a criminal past, including burglary, and had spent time behind bars, but that his history had nothing to do with the alleged attack.

The trial is expected to run for two weeks and will hear from several eyewitnesses as well as police, the paramedic who initially treated the pair, and medical experts.
